Terms and Conditions for Google My business Profile Services

Welcome to Adswinweb Digital Marketing! By availing our Google Business Profile (GMB) services, you agree to the terms and conditions outlined below. Please read them carefully to ensure complete understanding of our service offerings and the obligations of both parties.

1. Definitions

  • “Client” refers to the individual or business entity availing services from Adswinweb.
  • “Adswinweb” refers to Adswinweb Digital Marketing, providing Google Business Profile and digital marketing services.
  • “Service” refers to any work undertaken by Adswinweb, including GMB setup, number updates, suspension removal, business verification, SEO, business management, and ownership claim assistance.

2. Service Offerings & Scope

The following terms apply to all services provided by Adswinweb Digital Marketing:

2.1 New Google Business Profile Setup

  • Adswinweb will create a new Google Business Profile based on the information provided by the Client.
  • The Client is responsible for providing accurate business information, including name, address, contact details, and business category.
  • Adswinweb is not liable for delays caused by incomplete or incorrect information provided by the Client.

2.2 Contact Number Update

  • The service involves updating the contact number on the existing Google Business Profile.
  • Any verification required due to number changes will be the responsibility of the Client, though Adswinweb will provide guidance and support as needed.
  • If Google rejects the update request, Adswinweb is not liable for such rejections.
  • If Google asks for business documents or professional website then it is the responsibility of the clients to provide all the details to adswinweb

2.3 Suspension Removal

  • Adswinweb will analyze the cause of suspension and prepare a recovery strategy.
  • This service includes preparing and submitting an appeal to Google for suspension removal.
  • The outcome of the appeal is subject to Google’s discretion. No guarantees are made regarding the success of suspension removal.
  • Refunds will not be issued if suspension removal is unsuccessful due to non-compliance with Google’s policies or fraudulent activities by the Client.

2.4 Business Verification Assistance

  • Adswinweb provides support for Google Business Profile verification through email, postcard, or phone.
  • It is the Client’s responsibility to provide valid and accurate information for verification.
  • Adswinweb will not be held liable for delays or denials of verification due to issues such as incomplete address details, incorrect business data, or non-availability of the Client for phone verification.

2.5 Business Management & SEO

  • Adswinweb will manage and optimize the Client’s Google Business Profile for improved visibility and engagement.
  • Services include regular updates, SEO optimization, image uploads, business description updates, and keyword integration.
  • Adswinweb will not be held liable for performance issues arising from algorithm changes, Google policy updates, or client-requested changes that may negatively impact the profile.

2.6 Business Ownership Claim Assistance

  • Adswinweb assists Clients in claiming or reclaiming ownership of a Google Business Profile.
  • The Client must provide proof of ownership and any additional information requested by Google.
  • Adswinweb is not liable if ownership claim is unsuccessful due to lack of sufficient documentation or fraudulent claims.

3. Payment Terms & Service Timeline

  • All services require an advance payment as per the quotation provided. No service will be initiated until payment is received.
  • In case of service packages, payment terms will be discussed and agreed upon prior to the commencement of services.
  • Refund Policy:
    • No refunds will be provided if the service cannot be completed due to the Client’s non-compliance, misleading information, or Google’s refusal to approve the changes.
    • Partial refunds may be considered in cases where Adswinweb fails to deliver the service as outlined, excluding issues related to Client-provided data.
    • Service Timeline : Google Business Profile services can take up to 30 days but if we can’t resolve your issue within 45 days we’re committed to giving you a 100% refund

4. Client Obligations

  • The Client must provide accurate and up-to-date information required for setting up, verifying, or managing the Google Business Profile.
  • The Client must not engage in unethical, fraudulent, or misleading practices, such as providing false business information or misrepresenting the nature of their business.
  • Any changes requested by the Client post-service delivery that contradict Google’s policies or Adswinweb’s recommendations will be the sole responsibility of the Client.

5. No Guarantee Clause

  • Adswinweb does not guarantee specific outcomes for services rendered due to factors outside its control, including changes in Google algorithms, third-party policies, or external conditions affecting business visibility.
  • For suspension removal, business verification, and ownership claims, the final decision rests solely with Google. Adswinweb will not be responsible for any unfavorable decisions.

6. Limitation of Liability

  • Adswinweb shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services.
  • Liability is limited to the amount paid by the Client for the specific service rendered.

7. Service Termination

  • Adswinweb reserves the right to terminate services immediately without notice if it is found that the Client has violated Google’s policies, provided misleading information, or engaged in fraudulent practices.
  • No refund will be issued in case of service termination due to the Client’s non-compliance or unethical practices.

8. Intellectual Property

  • All content, strategies, and methodologies used in providing services to the Client remain the intellectual property of Adswinweb.
  • The Client is not permitted to share, distribute, or replicate any proprietary information without prior written consent from Adswinweb.

9. Confidentiality

  • Both parties agree to keep any sensitive business information shared during the course of service engagement confidential.
  • Adswinweb will not disclose, share, or sell client information to third parties unless required by law.

10. Dispute Resolution & Governing Law

  • Any disputes arising out of or relating to these terms and conditions shall be resolved through arbitration in the jurisdiction where Adswinweb is based.
  • These terms are governed by and construed in accordance with the laws of India.

11. Amendments

  • Adswinweb reserves the right to modify or update these terms and conditions at any time without prior notice. Clients are encouraged to review these terms periodically.

12. Acceptance of Terms

By proceeding with any service, the Client acknowledges that they have read, understood, and agree to be bound by these terms and conditions.
